1. Agreement to Terms

Welcome to PropertyEye Hub ("Platform," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of hub.propertyeye.rw, including all features, content, and services offered on or through the Platform.

By accessing or using PropertyEye Hub, you agree to be bound by these Terms and our Privacy Policy. If you disagree with any part of these Terms, you may not access or use the Platform.

These Terms apply to all users, including visitors, registered customers, and service providers ("Providers") who list their businesses on our Platform.

2. Platform Description

PropertyEye Hub is a digital marketplace that connects service seekers with verified service providers across Rwanda's real estate value chain, including but not limited to:

• Construction companies and contractors
• Plumbing and electrical services
• Interior design and decoration
• Property maintenance and repair
• Landscaping and gardening
• Architecture and engineering services
• Real estate agents and consultants
• Other real estate-related professional services

We provide the platform for connections; we do not provide the actual services and are not a party to agreements between customers and Providers.

3. Eligibility and Registration

3.1 Age Requirement

You must be at least 18 years old to use this Platform. By using PropertyEye Hub, you represent that you meet this age requirement.

3.2 Account Registration

Service Providers must:

• Provide accurate, current, and complete registration information
• Maintain and update account information to keep it accurate
• Maintain the security and confidentiality of login credentials
• Accept responsibility for all activities under their account
• Notify us immediately of any unauthorized use or security breach

3.3 Business Verification

Service Providers may be required to provide business registration documents, professional licenses, insurance certificates, or other verification materials. We reserve the right to verify all information and reject or suspend accounts that fail verification.

4. Service Provider Responsibilities

4.1 Business Listing Accuracy

Providers must ensure their listings contain:

• Accurate business name, description, and contact information
• Truthful representation of services, qualifications, and experience
• Current pricing information (when applicable)
• Real photos of their work, team, or business premises
• Accurate location and service area information

4.2 Professional Conduct

Service Providers agree to:

• Respond to customer inquiries in a timely and professional manner
• Provide services with reasonable skill and care
• Honor quoted prices and agreed-upon terms
• Maintain appropriate licenses, insurance, and permits required by Rwandan law
• Comply with all applicable health, safety, and building codes
• Treat customers with respect and professionalism

4.3 Prohibited Activities

Service Providers must NOT:

• Post false, misleading, or fraudulent information
• Use fake reviews or ratings to boost their profile
• Offer services they are not qualified or licensed to provide
• Attempt to circumvent platform fees or payment processes
• Solicit customers to transact outside the platform to avoid fees
• Harass, threaten, or discriminate against customers
• Copy or use content from other businesses without permission

5. Customer Responsibilities

5.1 Proper Use

Customers agree to:

• Use the Platform for legitimate service discovery and hiring purposes
• Provide accurate information when contacting Providers
• Treat service Providers with respect and professionalism
• Negotiate terms directly with Providers in good faith
• Pay agreed-upon amounts for services received

5.2 Reviews and Ratings

When submitting reviews, customers must provide honest, factual feedback based on actual experiences. Reviews must not contain offensive language, personal attacks, discriminatory content, or false statements. We reserve the right to remove reviews that violate these guidelines.

6. Subscription Plans and Payments

6.1 Service Provider Subscriptions

Service Providers may subscribe to various plans to enhance their visibility and access premium features. Current subscription options include:

• Free Trial (1 month) - Available once per business
• Starter Plan (3 months) - 5,000 RWF
• Professional Plan (6 months) - 8,000 RWF
• Business Plan (9 months) - 11,000 RWF
• Enterprise Plan (12 months) - 14,000 RWF

6.2 Payment Terms

• All subscription fees are charged in Rwandan Francs (RWF)
• Payments are processed through secure third-party payment processors
• Subscriptions are paid in full at the time of purchase
• All fees are non-refundable except as required by law
• We reserve the right to modify pricing with 30 days notice

6.3 Free Trial

New service Providers receive a one-time free trial subscription. This trial cannot be repeated. After the trial expires, Providers must subscribe to a paid plan to continue accessing platform features.

6.4 Cancellation and Refunds

Providers may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused subscription time, except in cases of platform failure or as required by Rwandan consumer protection law.

7. Intellectual Property Rights

7.1 Platform Content

All content on PropertyEye Hub, including text, graphics, logos, icons, images, software, and design, is the property of PropertyEye Hub or its licensors and is protected by Rwandan and international copyright laws.

7.2 User-Generated Content

Service Providers retain ownership of content they upload (photos, descriptions, business information). By posting content, Providers grant PropertyEye Hub a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute this content on the Platform for business purposes.

7.3 Copyright Infringement

We respect intellectual property rights. If you believe content on our Platform infringes your copyright, contact us at legal@propertyeye.rw with detailed information, and we will investigate promptly.

8. Platform Role and Limitations

8.1 We Are a Marketplace, Not a Service Provider

PropertyEye Hub provides a platform connecting customers with service Providers. We do not:

• Provide construction, plumbing, electrical, or any other professional services
• Employ, supervise, or control service Providers listed on the Platform
• Guarantee the quality, safety, legality, or reliability of services
• Verify all credentials, licenses, or qualifications (though we may conduct verification)
• Become a party to contracts between customers and Providers

8.2 No Endorsement

Listing on PropertyEye Hub does not constitute our endorsement of any Provider. Customers are responsible for conducting their own due diligence before hiring any service Provider.

9. Disclaimers and Limitation of Liability

9.1 Platform Provided "As Is"

PropertyEye Hub is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Service Quality

We do not guarantee that services provided by Providers will meet your expectations or be free from defects. Any disputes regarding service quality must be resolved directly between customers and Providers.

9.3 Limitation of Liability

To the maximum extent permitted by Rwandan law, PropertyEye Hub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the Platform
• Services provided by any Provider listed on the Platform
• Unauthorized access to or alteration of your data
• Statements or conduct of any third party on the Platform
• Any other matter related to the Platform

10. Indemnification

You agree to defend, indemnify, and hold harmless PropertyEye Hub, its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the Platform
• Services provided or received through the Platform

11. Dispute Resolution

11.1 Customer-Provider Disputes

Disputes between customers and Providers must be resolved directly between the parties. We may provide limited mediation assistance but are not obligated to do so.

11.2 Governing Law

These Terms are governed by the laws of the Republic of Rwanda. Any disputes shall be subject to the exclusive jurisdiction of the courts of Rwanda.

11.3 Informal Resolution

Before filing any legal claim, you agree to contact us at legal@propertyeye.rw to attempt to resolve the dispute informally.

12. Account Termination

12.1 Termination by User

You may terminate your account at any time by contacting support. Upon termination, your business listing will be removed from public view.

12.2 Termination by PropertyEye Hub

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, receive repeated customer complaints, or for any other reason we deem necessary to protect our Platform and users.

13. Modifications to Terms

We may revise these Terms at any time. Material changes will be communicated via email or prominent notice on the Platform at least 30 days before taking effect. Continued use after changes constitutes acceptance of the modified Terms.

14. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and PropertyEye Hub
• Severability: If any provision is found unenforceable, remaining provisions remain in effect
• No Waiver: Our failure to enforce any right does not waive that right
• Assignment: You may not transfer your rights; we may assign ours to affiliates or successors
• Force Majeure: We are not liable for delays caused by events beyond our reasonable control
